(1) This is an appeal by Ann Angelli, the Executrix of the Estate of an unsuccessful petitioner for divorce, from the denial of an award of counsel fees by the Family Court. The background of the divorce litigation and subsequent limited remand to the Family Court is set forth in the decision of this Court in Angelli v. Sherway, Del. Supr., 560 A.2d 1028 (1989). In that decision, this Court ruled that the deceased husbands appeal from the denial of a divorce petition had abated on appeal but that the Family Court was authorized under the provisions of 13 Del.C. §§ 1517(d) and 1518(c) to entertain a claim for counsel fees on behalf of the unsuccessful petitioner. Id. at 1037.
