Action in the district court for Sibley county by Anna Duenow and Henry Grack to restrain defendants (Walter and Loraine Lindeman) from obstructing a ditch located on the land of defendants and from interfering with plaintiffs in removing the obstructions complained of. After findings, Joseph J. Moriarty, Judge, that plaintiffs had acquired an easement by prescription over the lands of defendants to maintain, repair, and clean out said ditch for the drainage of surface waters, that the ditch be maintained at a certain depth as originally constructed, and enjoining defendants from in any manner obstructing the ditch, judgment by default was entered. From an order denying their motion to vacate the judgment and permit them to answer, defendants appealed.
